Client Agreement
These Terms govern the use of travel planning and booking services provided by Bound For Blue Travel Co.
PLEASE READ THESE TERMS CAREFULLY. THEY AFFECT YOUR LEGAL RIGHTS AND ALLOCATE RESPONSIBILITY FOR TRAVEL-RELATED RISKS.
These Terms and Conditions (the "Terms") are a binding agreement between you ("Traveler," "you," or "your") and Bound For Blue Travel Co. ("Bound For Blue," "Company," "we," "us," or "our"). If you accept these Terms on behalf of other travelers, you represent that you are authorized to act for them and agree to provide them with these Terms and all booking documents.
These Terms become binding when you do any of the following after receiving or being given conspicuous access to them:
A general inquiry or request for information, by itself, does not require you to purchase travel. If you do not agree to these Terms, do not authorize a booking or payment.
"Supplier" means any cruise line, tour operator, airline, hotel, resort, transportation provider, excursion operator, insurer, payment processor, or other independent provider of travel products or services.
"Booking Documents" include proposals, quotes, invoices, confirmations, itineraries, payment authorizations, supplier terms, and written fee disclosures.
These Terms govern your relationship with Bound For Blue. Supplier terms govern the products and services provided by that Supplier. If a Supplier's terms conflict with these Terms regarding the Supplier's own services, the Supplier's terms control for those services. A written Booking Document signed or expressly accepted by you controls over these Terms only to the extent it specifically identifies the provision being changed.
Agency disclosure. Bound For Blue Travel Co. is an Independent Contractor of Outside Agents, California Seller of Travel 2090937-50 (Registered Affiliate), Florida ST15578, Washington 603189022. Registration as a seller of travel does not constitute approval by the State of California.
Bound For Blue provides travel research, planning, advisory, reservation, and related administrative services. We arrange travel through our host agency and independent Suppliers. Unless expressly stated in writing, Bound For Blue does not own, operate, manage, or control any Supplier or the travel services a Supplier provides.
Suppliers are independent entities and are solely responsible for their acts, omissions, schedules, equipment, personnel, accommodations, safety standards, service delivery, refunds, credits, and compliance with applicable law. Bound For Blue is not a party to the contract between you and a Supplier except to the limited extent expressly stated in a Booking Document.
We may receive commissions, incentives, or other compensation from Suppliers or our host agency in connection with travel you book. Such compensation does not increase a quoted Supplier price unless specifically disclosed.
All quotes are subject to availability and are not guaranteed until the applicable Supplier confirms the reservation and required payment is received. Prices, promotions, cabin assignments, categories, schedules, taxes, port expenses, government fees, fuel supplements, exchange rates, and other charges may change without notice before confirmation. Unless expressly stated otherwise, prices are quoted in United States dollars.
You are responsible for reviewing what is included and excluded. Airfare, gratuities, transfers, shore excursions, specialty dining, beverages, Wi-Fi, insurance, baggage fees, resort fees, parking, visas, testing, and other items are not included unless the Booking Document expressly says they are.
Obvious typographical, computational, or Supplier transmission errors do not create a right to an incorrect price or benefit. If an error is discovered before confirmation, you may accept the corrected terms or decline to proceed. If a Supplier corrects an error after confirmation, the Supplier's rules and applicable law will govern.
Bound For Blue may charge professional fees for planning, consultation, research, booking management, changes, cancellations, group coordination, or other services. Any Company fee will be disclosed in writing before it is assessed. Company fees are separate from Supplier charges and, once work has begun, are nonrefundable except as stated in the applicable written fee disclosure or required by law.
No fee is authorized merely because you submit a general inquiry. If a proposal or invoice identifies a fee, your express approval or payment authorizes that fee.
Each booking is also subject to the applicable Supplier's contract, ticket terms, conditions of carriage, fare rules, cancellation schedule, health and safety rules, check-in deadlines, and other policies. You agree to review those terms when provided or made available. By authorizing a booking, you agree to comply with them.
Supplier policies may change after booking. Bound For Blue will communicate material changes that we receive and can reasonably identify, but we do not control Supplier notices or guarantee that a Supplier will preserve a promotion, itinerary, amenity, or policy.
You authorize the applicable Supplier, host agency, or authorized payment processor to charge the payment method you approve for the amounts and dates shown in the Booking Documents. Bound For Blue may facilitate payment instructions but does not guarantee that a payment has been received until confirmation is issued.
You are responsible for providing accurate billing information, maintaining sufficient available funds, and meeting all deposit and final-payment deadlines. A reservation may be canceled automatically, repriced, or lose promotional benefits if payment is late, declined, reversed, or incomplete. Bound For Blue is not responsible for interest, overdraft charges, foreign-transaction fees, exchange-rate differences, or other charges imposed by your financial institution.
Except where expressly agreed in writing, Bound For Blue does not hold client funds in trust. Payments for Supplier services may be processed directly by the Supplier, through the host agency, or through an authorized payment processor.
You must provide each traveler's full legal name, date of birth, citizenship, contact information, and other required details exactly as shown on the travel document that person will use. You represent that all information you provide is accurate, complete, and submitted with proper authority.
You are responsible for promptly reviewing every quote, invoice, confirmation, itinerary, cabin assignment, passenger name, travel date, price, and payment deadline. Report any discrepancy in writing immediately. Delayed corrections may be unavailable or may result in Supplier change fees, fare differences, or cancellation penalties.
Each traveler is solely responsible for obtaining and carrying the correct passport, visa, identification, consent form, vaccination record, proof of onward travel, and any other document required by each departure, transit, and destination jurisdiction. Requirements may vary based on citizenship, residency, age, itinerary, criminal history, and other individual circumstances.
Bound For Blue may provide general information as a convenience, but does not provide legal or immigration advice and does not guarantee entry or boarding. Travelers must independently verify current requirements with the relevant government authorities and Suppliers well before departure. Denied boarding, denied entry, delay, detention, or additional expense caused by missing, expired, damaged, or insufficient documents is the traveler's responsibility.
A parent, legal guardian, or other properly authorized adult must approve travel for a minor and provide all required consent and custody documents. Supplier age restrictions, supervision rules, and cabin-occupancy policies apply. The person accepting these Terms for a minor represents that they have legal authority to do so.
Travelers are responsible for determining whether they are medically and physically fit for the planned travel. You must notify Bound For Blue before booking of any mobility, accessibility, dietary, medical, sensory, service-animal, or other accommodation request that may affect Supplier selection or arrangements. We will communicate disclosed requests to the relevant Supplier but cannot guarantee that any request will be available or fulfilled.
Suppliers may impose medical clearance, vaccination, pregnancy, age, weight, mobility, or participation requirements. Travelers must review and comply with those requirements. Bound For Blue does not provide medical advice. If a traveler has a health concern, that traveler should consult an appropriate licensed medical professional before travel.
Travel insurance is strongly recommended. Depending on the policy, insurance may provide coverage for trip cancellation or interruption, medical treatment, emergency evacuation, baggage loss or delay, and other covered events. Coverage, exclusions, deadlines, pre-existing condition rules, and claims decisions are controlled solely by the insurer and policy.
Bound For Blue does not underwrite insurance and does not guarantee coverage or payment of any claim. You are responsible for reviewing the full policy and deciding whether it is appropriate. If you decline insurance or purchase insufficient coverage, you accept the risk of losses that would otherwise have been covered. Supplier penalties remain enforceable regardless of insurance coverage or claim outcome.
Suppliers may change ships, aircraft, cabins, ports, routes, schedules, hotels, venues, excursions, or other services for operational, safety, weather, regulatory, or other reasons. A port, attraction, amenity, or event is not guaranteed unless the Supplier expressly guarantees it in writing.
Bound For Blue will use commercially reasonable efforts to assist with alternatives when requested, but all alternatives remain subject to availability, additional cost, and Supplier approval. We are not responsible for loss resulting from a Supplier's substitution, delay, cancellation, or schedule change.
Neither Bound For Blue nor any Supplier will be responsible to the extent performance is prevented, delayed, or materially affected by circumstances beyond the applicable party's reasonable control, including severe weather, natural disaster, epidemic, pandemic, war, terrorism, civil unrest, labor dispute, government action, border closure, cyberattack, utility or communications failure, transportation interruption, mechanical failure, or similar event.
Refunds, credits, rebooking, and additional costs arising from such events are determined by the applicable Supplier's terms and any insurance policy, subject to applicable law.
All changes and cancellations are subject to Supplier rules, availability, fare differences, penalties, and Company fees previously disclosed in writing. Penalties may increase as departure approaches and may reach the full booking price. Some fares, deposits, add-ons, insurance premiums, and professional fees may be nonrefundable from the time of purchase.
Send change or cancellation requests to info@boundforblue.com. A request is not effective until Bound For Blue confirms receipt in writing or the Supplier confirms the change or cancellation. If a deadline is imminent and you have not received confirmation, you are responsible for contacting the Supplier directly and then notifying Bound For Blue.
If you believe a charge is incorrect, contact Bound For Blue promptly so the matter can be investigated. Nothing in these Terms limits a legal right to dispute an unauthorized or incorrect charge. However, initiating a chargeback does not itself cancel a booking, eliminate a valid Supplier penalty, or release you from an amount properly due under an accepted Booking Document.
Travelers must comply with applicable laws, Supplier rules, safety instructions, check-in times, and standards of conduct. A Supplier may refuse service, remove a traveler, or cancel arrangements for disruptive, unsafe, unlawful, abusive, or noncompliant conduct. Any resulting loss or expense is the traveler's responsibility to the extent permitted by law.
You consent to receive Booking Documents, notices, disclosures, and signatures electronically at the email address or telephone number you provide. Electronic records and signatures have the same effect as paper records and handwritten signatures to the extent permitted by law.
You are responsible for monitoring your communications, maintaining current contact information, and reviewing messages promptly. You may request a paper copy of a record, but doing so does not delay a payment or Supplier deadline unless Bound For Blue expressly agrees in writing.
Bound For Blue collects and uses personal information reasonably necessary to respond to inquiries, prepare travel options, make and service bookings, process authorized payments, communicate with travelers, prevent fraud, and meet legal or regulatory obligations. To perform these services, we may share necessary information with our host agency, Suppliers, insurers, payment processors, technology providers, and government authorities.
You represent that you are authorized to provide personal information for every traveler in your party. Do not send sensitive payment or identity information through an unsecured channel when a secure method is available.
Bound For Blue will perform its professional services with reasonable care. Except for that express commitment and to the fullest extent permitted by law, the website, planning services, recommendations, and information are provided "as is" and "as available," without any other express or implied warranty, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, or uninterrupted access.
Recommendations reflect information available at the time and professional judgment about fit. They do not guarantee a particular experience, outcome, weather condition, service level, cabin environment, dining experience, port call, or traveler satisfaction.
TO THE FULLEST EXTENT PERMITTED BY LAW, BOUND FOR BLUE IS NOT LIABLE FOR THE ACTS, OMISSIONS, NEGLIGENCE, BANKRUPTCY, INSOLVENCY, DEFAULT, DELAY, CANCELLATION, INJURY, DEATH, PROPERTY DAMAGE, DATA INCIDENT, OR OTHER CONDUCT OF ANY INDEPENDENT SUPPLIER OR OTHER THIRD PARTY.
TO THE FULLEST EXTENT PERMITTED BY LAW, BOUND FOR BLUE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST ENJOYMENT, LOST OPPORTUNITY, EMOTIONAL DISTRESS, OR LOSS OF DATA, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, BOUND FOR BLUE'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO A BOOKING OR THESE TERMS WILL NOT EXCEED THE GREATER OF FIVE HUNDRED UNITED STATES DOLLARS (US $500) OR THE PROFESSIONAL FEES ACTUALLY PAID TO BOUND FOR BLUE FOR THE BOOKING GIVING RISE TO THE CLAIM. AMOUNTS PAID TO SUPPLIERS FOR TRAVEL SERVICES ARE NOT PROFESSIONAL FEES PAID TO BOUND FOR BLUE.
These limitations do not apply to liability that cannot lawfully be excluded or limited. Nothing in these Terms excludes liability for Bound For Blue's fraud, willful misconduct, or gross negligence to the extent such liability cannot be limited under applicable law.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Bound For Blue and its owner, personnel, contractors, and representatives from third-party claims, damages, liabilities, penalties, costs, and reasonable attorneys' fees arising from:
This section does not require you to indemnify any person for that person's own fraud, willful misconduct, or negligence to the extent prohibited by law.
Before filing a lawsuit arising from these Terms or Bound For Blue's services, the complaining party must send written notice describing the dispute, the relevant booking, the relief requested, and supporting documents. Notice to Bound For Blue must be sent to info@boundforblue.com. The parties will attempt in good faith to resolve the dispute for at least thirty days after receipt of the notice. Either party may seek urgent temporary relief when necessary to prevent immediate and irreparable harm.
These Terms and any dispute arising from them or Bound For Blue's services are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Subject to any law that requires a different forum, the state courts located in Douglas County, Colorado, and the United States District Court for the District of Colorado will have exclusive jurisdiction. Each party consents to personal jurisdiction and venue in those courts.
Website text, graphics, branding, selection, arrangement, and original content are owned by or licensed to Bound For Blue and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial travel research and communication with Bound For Blue. You may not copy, scrape, republish, sell, interfere with, reverse engineer, introduce malicious code into, or use the website or its content for an unlawful purpose.
Supplier names, trademarks, photographs, and content belong to their respective owners. References to them do not imply ownership by Bound For Blue.
Bound For Blue may revise these Terms prospectively by posting an updated version with a new effective date. A revision will not retroactively change a confirmed booking unless required by law, required by a Supplier for its services, or expressly accepted by you. The version accepted in connection with a booking remains applicable to that booking, subject to those exceptions.
You may not assign your rights or obligations under these Terms without our written consent. Bound For Blue may assign these Terms in connection with a merger, sale, reorganization, transfer of substantially all relevant assets, or transition to a successor business or host agency, subject to applicable law.
A failure to enforce a provision is not a waiver. If a provision is held unlawful or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not permitted. The remaining provisions will continue in effect.
These Terms, together with the accepted Booking Documents and applicable Supplier terms, constitute the entire agreement between you and Bound For Blue concerning the subject matter and replace prior or contemporaneous discussions or representations on that subject. No oral statement changes these Terms.
Provisions that by their nature should continue after completion or termination will survive, including payment obligations, Supplier terms, privacy obligations, intellectual-property rights, disclaimers, limitations of liability, indemnification, dispute provisions, and this survival clause.
Except for persons expressly protected by the limitation-of-liability or indemnification provisions, these Terms are solely for the benefit of the parties and do not create rights in any other person.
